By using this website in any manner and any of the services offered or provided by The CraftStar, you hereby agree to be bound by all the Terms and Conditions herein.

1.  Who and What is The CraftStar?    

The CraftStar is an e-commerce website for Sellers to post and to sell items and for Buyers to pay for the items.  The CraftStar does not warrant or guarantee the truth or accuracy of any listings or the ability of the Buyers to purchase any of the items listed.  Therefore, The CraftStar is not liable in any manner for any representations by the Seller, the Buyer, or any user of this website and you use the services herein AT YOUR OWN RISK.   The CraftStar specifically reserves the right to refuse membership to any individual.  In this regard, any individual under the age of eighteen (18) years must hereby represent that it is utilizing the services of The CraftStar under the supervision of an adult parent or legal guardian who will be responsible for all the activities and transaction of the minor. 

By utilizing this website, you hereby AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS HEREIN and that you will abide by all laws and be responsible for all applicable taxes.

2.  Membership.  

The CraftStar is a Membership Service.  IT IS IMPORTANT FOR YOU TO KNOW THAT ANY SELLER OF ITEMS must make handmade goods, which is defined as a creative composition designed and made by you.  Alternatively, for the purposes of Membership, a Seller can be a person who sells crafting supplies comprising of either commercial or handmade supplies.  A Seller can also be a person who sells vintage items: the definition being the item is at least 20 years old. With prior permission from The CraftStar, a Seller operating a shop may do so as the representative of a crafting group they are in.  No other person can be deemed a Seller.  Sellers of items must be Members.  In order for a Seller to be a Member, the Seller must abide by all the Terms and Conditions herein.  Correspondingly, any Buyer must abide by all the Terms and Conditions herein.  Further, all contributors of content, information and other materials and services also agree to be bound by these Terms and Conditions.

3.  How to become a Member?  

You will first sign up using name and email address.  When registered, you will be asked to accept the Terms before continuing and/or opening your shop.  It is your full responsibility to keep your password secure.  You agree that if you fail to do this, you will be fully liable for all damages that result from this failure.  Therefore, you cannot supply this information to any other person or entity.  You also cannot assign your membership or account to any other person or entity.  After you have agreed to The CraftStar Terms, you will be asked to set up your account with your user name (shop name) and password.  It is understood and agreed that you will access The CraftStar through LOG IN on site and pay monthly membership fee of $5.00 through PayPal or Credit Card using our third party service - Stripe.

4.  What Services are Available to Members?  

This list of services will grow as we go forward.  Members may open a Shop with their chosen name.  Members will be able to promote items via Facebook, Twitter, Google +,  and Pinterest directly from their shop.  There is a Chat feature which is open for Members use, as well as Forums.  Shops have the ability to localize themselves by flagging their items Made in USA,  “Made In UK, etc.  An Eco-Friendly flag is available as well as "Vintage."

Members may have and control multiple Shops from one log in.  

5.  What are the Fees for Sellers?  

You will be notified by email when one of your items sells.  

There is a basic membership fee of $5.00 per month for unlimited listings, and unlimited shops.  This fee will be due on a monthly basis.  It will be up to you to "re-list" sold items. 


PayPal: there will be a 2.5% transaction fee for each sale (pre-shipping costs).  Credit Card Payments: There will be a 3.5% processing fee plus 30 cents per checkout (to cover the buyers bank transaction fees).  These fees will be deducted at the time of the sale.  

You are fully responsible for paying all fees and applicable taxes while utilizing The CraftStar.  You must keep your Account information up to date at all times.

6.  Termination. 

In the event The CraftStar terminates your account or a listing or if you close your account or your fees cannot be processed, you remain fully responsible for all unpaid amounts and risk suspension of your membership and all other privileges.  The CraftStar reserves the right, in its sole discretion, to cancel unconfirmed or inactive accounts or refuse services to anyone at any time for any reason.

You can terminate your membership with The CraftStar at any time.  To close your shop, log in to your account, and click the DELETE button next to your shop name.   As we don't hold financial information on site, please remember, that you will also need to terminate the membership payments through PayPal or Stripe (whichever you signed up with.)  The CraftStar is not responsible for payments made if you haven't cancelled your membership plan.

7.  What is Important for Members and any other User of the Website to Understand.

You are solely responsible for your postings, representations, comments, transactions, delivery of items, store guidelines, and any and all of your conduct and activity on the website and with regard to The CraftStar.  Accordingly, you specifically and unreservably agree that you will not make any misrepresentations and infringe on any one elses intellectual property rights or any other rights including but not limited to publicity or privacy.  Further, you will not utilize, promote or attempt to sell any illegal, dangerous, hazardous, pornographic, unsuitable, controversial, offensive or obscene items, or do anything to create any civil liability or violate any applicable law, statute, ordinance or regulation.

We ask you not to include links in your listings to other e:commerce sites.  We will ask you to take these out if we see them.

8.  What about the content you provide. 

You provide any and all content entirely AT YOUR OWN RISK without any liability whatsoever to The CraftStar.  In providing this content, you represent that you have all rights to do from any third party or any applicable individual or company to utilize every aspect of the content and hereby fully indemnify and release The CraftStar from any liability in connection therewith.  You also understand and agree that The CraftStar has the absolute right, in its discretion, to refuse to post and the right to remove the content you provide if it deems in its sole discretion said content to be illegal, dangerous, hazardous, pornographic, unsuitable, controversial, offensive or obscene or infringes on any person or entities, intellectual property rights or other rights including but not limited to publicly or privacy.  You further grant The CraftStar a perpetual worldwide, irrevocable royalty free license and/or sublicense to utilize the content for the purposes of operating the website.

9.  Notification of Potential Infringement of Third Party Intellectual Property Rights.     

The CraftStar abides by the US Intellectual Property Laws and the Digital Millennium Copyright Act.  You understand that at any time you are notified that any content that you have provided The CraftStar infringes or potentially infringes on any person or entities intellectual property rights (including copyright infringement), you are to provide immediate written notification of this to The CraftStar in care of the Designated Agent.  The Notice must include all the written details of said alleged infringement.  On Notice of this alleged infringement, The CraftStar may, at its discretion, remove said content and/or discontinue service to the offender.  If The CraftStar removes such content, if applicable, it will make a reasonable attempt to notify the Member of such removal.

10.  The CraftStars Intellectual Property

The CraftStar is a registered trademark and any of its trademarks and/or trade dress may not be used by any other party other than The CraftStar in any manner.

11.  Dispute Resolution and Governing Law.

Any disputes arising from the utilization of this website or its related services shall be resolved exclusively through binding arbitration through the American Arbitration Association in Los Angeles according to its Rules.  The governing law will be California law and any dispute shall be heard in Los Angeles, California. 

12.  No Warranty.  

The CraftStar, its officers, directors and employees, affiliates and agents provide The CraftStars website and services AS IS" and without any warranty or condition, express, implied or statutory, The CraftStars subsidiaries, officers, directors, employees, affiliates and agents specifically disclaim any implied warranties of title, merchantability, performance, fitness for a particular purpose.  In addition, no advice or information (oral or written) obtained by you from The CraftStar shall create any warranty.  Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you.  This Warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.

13.  Liability Limit.  

In no event shall The CraftStar, and its officers, directors, employees, affiliates and agents, be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or accidental, arising out of or relating to the conduct of you or anyone else in connection with the use of this website, The CraftStars services, or any aspect of these Terms and Conditions, including without limitation, lost profits, bodily injury, emotional distress, or any special, incidental or consequential damages.  Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

In the event the exclusion of liability does not apply, The CraftStars liability and the liability of The CraftStars officers, directors, employees, affiliates and agents to you or any third parties in any circumstances is limited to the greater of (I) the amount of fees you pay to The CraftStar, in the 12 months prior to the action giving rise to liability, and (ii) the amount of One Hundred Dollars ($100).

14.  Indemnity.  

You agree to indemnify and hold The CraftStar, and The CraftStars officers, directors, employees, affiliates and agents, harmless from any claim or demand, including reasonable attorneys fees, made by any third party to or arising out of your breach of the Terms and Conditions or any related claims, or your violation of any law or the rights of a third party.

15.   Severability.  

If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of the Terms and Conditions shall remain in full force and effect.

16.  No Agency.  

You and The CraftStar are Independent Contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by these Terms and Conditions.

17.  The CraftStars Service

 It is understood and agreed that The CraftStar reserves the right to modify or terminate The CraftStars service for any reason, without notice, and without liability, at any time.  The CraftStar reserves the right to alter these Terms of Use or other website policies at any time, you must review the Terms of Use on a regular basis.
